Adult Services and Health Cabinet Advisory Team

Appointments Committee

Cabinet

The Cabinet comprises the Leader and nine Cabinet Members each with a defined portfolio (or areas of responsibility). Collectively, the Cabinet will make recommendations to the Council on the Council’s overall policy direction.

Council

The Council is responsible for approving the overall policy framework including the budget and retains responsibility for regulatory functions (most of which it will delegate to committees operating within the ‘Constitutional’ arm of the decision-making structure. The Council will also have a key role in holding the executive to account.

Culture and Leisure Cabinet Advisory Team

Education Staffing Committee

The Council appoints an Education Staffing Committee to hear representations against notification of intent to declare posts redundant, submitted by teaching staff employed in non-delegated schools; to determine matters relating to the discipline or dismissal of non-school-based teaching staff and teaching staff in non-delegated schools and to hear representations from non-school based teaching staff in accordance with Stage 3 of the Management of Absence Non-School based Teaching Staff procedures. Emergency Committee

In the event of a serious incident and/or major emergencies where the District Emergency Co-ordinator considers that the Emergency Committee is required to be convened, the Committee shall consider and approve requests for funding above and beyond normal allocated budget expenditure; provide guidance on issues of national significance; assist in briefing Council Members as appropriate and authorise any other actions that may be deemed appropriate under the prevailing circumstances which would otherwise require a decision of the Cabinet, an individual Cabinet Member or the full Council.

General Purposes Appeals Panel

The Council appoints a General Purposes Appeals Panel to determine various appeals from teaching staff and applications for discretionary student awards. In addition, the Panel considers and determines appeals against decisions of the Executive Director for Social Inclusion and Health or the Heads of Service reporting to him/her with regard to residential and non-residential services; residential and nursing homes and representations for registration under the provisions of the Registered Homes Act 1984, the Registered Homes (Amendment) Act 1991 and the Children Act 1989. General Purposes Committee

The Council appoints a General Purposes Committee to deal with a diverse range of issues, in particular to make recommendations to Council on the appointment of representatives on outside bodies, civic and ceremonial matters, all matters relating to the boundaries of the Borough and the Wards, the registration of electors and the conduct of European, Parliamentary and local government elections and the power to make, amend, revoke and re-enact by-laws. The Council appoints a Joint Consultative Panel comprising elected members and Trade Union representatives in order to provide a means of consultation and a forum for discussion between the Council and its Local Government services employees and craft employees on matters relating to the conditions of service of such employees of the Council, on other matters of common interest and concern and to assist in the consultation process.

Licensing Committee

The Council has established a licensing Committee to deal with all matters relating to the discharge of the functions of the Licensing Authority under the Licensing Act 2003 and any regulations made under that Act, together with any related functions, with the exception of any function conferred on the Licensing Authority by Section 5 of the Licensing Act 2003 (Statement of Licensing Policy) and any function discharged under Section 5(a) of that Act by a committee other than the Licensing Committee. Rowley Regis Town Committee

Sandwell Local Access Forum

The Countryside and Rights of Way Act 2000 has placed a duty on Sandwell Council to establish an advisory body known as the Sandwell Local Access Forum. The Sandwell Local Access Forum is constituted in accordance with the Local Access Forums (England) Regulations 2002. Its purpose is to provide independent advice to highway authorities on access to open areas for informal recreational purposes and in the preparation of rights of way improvement plans. The Forum will cover the whole of the Sandwell Metropolitan Borough.

The Schools Forum is constituted in accordance with the Schools Forum (England) Regulations 2002 and Section 47A of the Schools Standards and Framework Act 1998 (as amended). The purpose of the Forum is to provide a means of ensuring good dialogue and an active interchange of advice and consultation between schools and the Local Education Authority (LEA) on matters relating to the Schools Budget.

Scrutiny Management Board

The Council appoints a co-ordinating scrutiny panel called the Scrutiny Management Board. The remit of this Board is to approve the Annual Scrutiny Work Programme, including those of other scrutiny panels; to retain or determine which panel will assume responsibility for any particular issue; to have the powers of overview and scrutiny in relation to Health Authority and associated matters; complaints handling and Ombudsman investigations; matters not within the remit of any other scrutiny panel. Select Committee on Heritage and Culture

The Council has established a Select Committee to examine the Heritage and Cultural provision in the Borough in the light of the Audit Commission’s Regular Performance Assessment of Culture, and to identify actions needed to improve the Council’s RPA score from 2 to 3.

Select Committee on Older People

The Council has established a Select Committee to explore the Council’s priority for improving services to older people, with particular reference to the contribution made by the statutory, voluntary and community sectors as well as by the Council.

Select Committee on Young People

The Council has established a Select Committee to explore the Council’s Corporate Priority for Improvement of “Things for Young People to Do” with particular reference to the contribution made by the statutory, voluntary and community sectors as well as by the Council.

Smethwick Town Committee

The Council appoints six Town Committees to involve, consult and represent the community on local issues and on the various policies and strategies of the Council; to consider and to determine the allocation of the local area budget; and to be consulted by the Executive and by the Council, as appropriate, on such matters as major developments, changes to local services and facilities and traffic management issues. Standards Committee

The Council at its Annual Meeting each year establishes a Standards Committee. Article 9 of the Council's Constitution sets out the composition of the committee and its role which includes being the guardians of standards of conduct including compliance with a Members’ Code of Conduct and a protocol on member/officer relations. State of the Borough Event

The Council’s Constitution provides that the Council will hold an annual State of the Borough event in order to facilitate debate between members of the Council and its partners on the progress of Sandwell towards the achievement of the 2020 vision and the Sandwell Plan. Whereas in previous years this has taken the form of an Extraordinary Meeting of the Council, it was agreed that this year the annual debate should take the form of a meeting between the Cabinet, Scrutiny Management Board and Sandwell Partnership Partners, and that all Members of the Council should be invited to also participate if they so wished. Strategic Resources Cabinet Advisory Team

Cabinet Members acting individually, have the responsibility for determining matters which fall within their portfolios. The Cabinet Member will take decisions in the public arena (except where exempt or confidential information is involved) and they will do this formally at a Cabinet Advisory Team. Other members such as Cabinet Advisors, the Chair of a relevant Scrutiny Panel and named opposition representatives may also attend and express their views but it is stressed that only the Cabinet Member is responsible for taking the decision, no one else.
